The Supreme Court in Kingston ruled in favor of ATL Automotive in a lawsuit concerning the alleged failure to repair a defective part in a customer's Volkswagen Polo. Justice Tara Carr found that the customer, Recardo Lugg, did not prove a breach of contract. Lugg claimed ATL Automotive failed to replace a mechatronic part in his car. The vehicle was purchased in 2012, and the warranty expired in 2014. The issue was reported in 2016 and again in 2018. ATL Automotive denied the allegations. The court heard testimony that the mechatronic was replaced in 2016. Lugg admitted the car worked well for two years after the 2016 repair. The judge found no evidence the mechatronic was not replaced. ATL Automotive was represented by attorneys Khara East and Conrad George.
